Terms of Service

Effective [CONFIRM: effective date]. Draft for owner review.

These Terms are an agreement between you and [CONFIRM: legal entity name, e.g. an LLC, or Francisco Whittaker as a sole proprietor] ("Liber Lane," "we," "us") for using liberlane.com and renting a Liber Lane vehicle directly from us. By creating a profile or requesting a booking you agree to these Terms, the booking policy shown at checkout, and the rental agreement on the booking and trip pages. If they conflict, the booking policy and rental agreement you accepted for that trip control for that trip.

Our Privacy Policy explains how we handle your information.

1. Who can rent

2. Your account

You can sign in with Google (Microsoft may also be offered) or with the email profile form. Keep your sign-in and your trip page link private; you are responsible for activity under your profile. Tell us right away if you think someone else has used it.

3. Booking and prices

4. Security hold

The booking page shows whether a refundable security hold applies and its amount. A hold may be set for all cars or per car, and some cars may have none. [CONFIRM: hold amounts; the live site currently shows no hold required.]

5. Charging and tolls

The trip price covers the booked days. It does not include electricity you use or tolls the vehicle incurs, unless an invoice says a charge was already included.

6. Pickup, return, no-shows, and late returns

7. Damage checklist and vehicle condition

8. Insurance and responsibility

The host maintains insurance on the vehicle. You are responsible for the car during the trip, including tickets, tolls, and damage or charges the host's policy does not pay. Turo's protection plans do not apply to direct bookings.

At check-in you upload a photo of your own insurance card. [CONFIRM: the actual coverage wording, deductible, whether the renter's personal auto policy is primary, and whether a damage waiver is offered. The site still shows the built-in placeholder coverage note.]

Nothing on the site is a certificate of insurance or legal advice.

9. Using the vehicle

10. Referral credit and promotions

11. Trip messages and uploads

Use the trip page to message the host. Messages and uploads must be about your trip and must not be unlawful or abusive. You give us permission to store and use what you upload (IDs, insurance cards, photos, messages) to run your booking and handle any claim, as described in the Privacy Policy.

12. Turo bookings

Trips booked on Turo are governed by Turo's terms, policies, fees, and protection plans, not by sections 3 through 10 of these Terms. Our site may show those dates as blocked.

13. The website

14. Disclaimers and limits of liability

The site is provided as is. To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, and our total liability for any claim about a booking is limited to the amount you paid for that booking [CONFIRM: liability cap]. Nothing in these Terms limits liability that cannot be limited by law, including for our gross negligence or willful misconduct.

You agree to cover losses, fines, and reasonable costs we incur because you broke these Terms or the law while the car was in your care, to the extent the law allows.

15. Governing law and disputes

Virginia law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally. Any claim must be brought in the state or federal courts serving [CONFIRM: county, e.g. Fairfax County or Loudoun County], Virginia, and you and we consent to those courts, except that either side may use small claims court where eligible.

16. Changes and termination

We may update these Terms by posting a new version here with a new effective date. Changes do not alter a booking already confirmed, except where the law requires. We may suspend or close a profile that breaks these Terms; amounts already owed remain owed.
